May 2024: We are happy to congratulate our client, financial advisor Glen Dowden, on a successful expungement award. The FINRA Panel, in an explained decision, found that the customer's allegations of unsuitable recommendations relating to pension rollover were clearly erroneous and false. Simply stated, he didn't do what he was accused of in the statement of claim. Hats off to him on the win and new journey! January 2020: Will Haddad was quoted in a recent Massachusetts Lawyers Weekly article -- "Financial Services Bar Gears Up for State Fiduciary Rule." Haddad was quoted as saying, "I don't know that the rule is really going to move the needle in Massachusetts in terms of how industry players view the [Massachusetts Securities Division]." Haddad added, however, that, under the new rule, "brokers that are giving transaction-based advice would be held not simply to the duty of reasonable care [under Regulation BI], but to a duty of care and loyalty, meaning in all instances you have to absolutely put the customer's interest ahead of yours as a financial professional." November 2019: Will Haddad was quoted in a recent Massachusetts Lawyers Weekly article on the Supreme Judicial Court's (SJC) decision in UBS Financial Services, Inc. v. Aliberti, in which the SJC found that the commercial custodian of non-discretionary individual retirement accounts did not owe a fiduciary duty to a named beneficiary of those accounts, but the beneficiary could maintain a suit under G.L. 93A. Haddad was quoted as saying, "The court took something away and offered something in return," noting that Chapter 93A opens up the possibility of a treble damages award and attorney's fees. Haddad also said that the SJC's decision should highlight for financial firms the need to have appropriate policies and procedures in place to ensure that inquiries like the beneficiary's "go up the chain" and do not stagnate.

March 2017: Will Haddad Quoted in ACA Insight on Investment Adviser Disclosure Duties.
In a recent ACA Insight article, Will was quoted on an SEC case alleging that an investment adviser failed to disclose, let alone seek approval for, a new compensation scheme:
"While it may seem to an adviser providing ‘additional’ services to a client in a volatile time that it should be paid for those additional services, the SEC has made clear that advisers cannot make up compensation schemes from whole cloth and not tell the client about it," said Pasquarello Fink partner William Haddad. "Even if Landress and his firm believed that they were ‘owed’ this money for their hard work in a tough market climate, the decision of whether to award such additional compensation clearly rested with the funds’ advisory committee (comprised of representatives from the funds’ limited partners)."
